Welcome to the website of the Bulgarian Game Dev Association (“BGDA”, “Association”, “we”, “us”, or “our”), accessible at bgda.bg (the “Website”). BGDA is a nonprofit association registered in Bulgaria, dedicated to the growth, representation, and promotion of the Bulgarian game development industry.

By accessing or using our Website, you (“User”, “you”, or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Website. These Terms constitute a legally binding agreement between you and BGDA.

The Website is available to all visitors for informational purposes. Certain features, including membership applications, access to member resources, and event registration, may require the creation of a user account.

By creating an account, you represent and warrant that:

1. You are at least 18 years of age or have the legal capacity to enter into a binding agreement;

BGDA reserves the right to suspend or terminate any user account at its sole discretion, including in cases of suspected fraudulent activity, violation of these Terms, or misuse of the Services.

BGDA offers membership to game development studios, independent developers, students, freelancers, and industry partners who share the Association's mission of developing and promoting the Bulgarian game development industry.

Membership applications are subject to review and approval by the Association's Board of Directors. Membership is governed by the Statutes of BGDA, which constitute a separate and complementary legal document. In the event of a conflict between these Terms and the Statutes, the Statutes shall prevail with respect to membership rights and obligations.

Membership benefits may include, but are not limited to: access to consulting services in fundraising, legal support, and M&A; representation at national and international industry events; participation in community events, meetups, and game jams; and educational and training opportunities.

Annual membership fees, if applicable, are determined by the Board of Directors and communicated to Members in advance. Failure to pay applicable fees may result in the suspension or termination of membership.

All Content on the Website, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and design elements, is the property of BGDA or its content suppliers and is protected by Bulgarian and international copyright, trademark, and other intellectual property laws.

The BGDA name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Association. You may not use these marks without the prior written consent of BGDA.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and its Content for personal, non-commercial purposes only. Any reproduction, distribution, modification, creation of derivative works, public display, or commercial exploitation of any Content without the express written permission of BGDA is strictly prohibited.

Certain areas of the Website may allow Users to submit, upload, or otherwise make available content, including but not limited to company profiles, project descriptions, comments, and event submissions (“User Content”).

By submitting User Content, you grant BGDA a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Association's purposes and activities.

You represent and warrant that: you own or have the necessary rights to submit such User Content; your User Content does not infringe the intellectual property rights or other rights of any third party; and your User Content does not contain any unlawful, defamatory, obscene, or otherwise objectionable material.

BGDA reserves the right to remove or edit any User Content at its sole discretion, without notice, for any reason, including content that violates these Terms or is deemed harmful to the Association's reputation or interests.

BGDA is committed to protecting your privacy and processing your Personal Data in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and the Bulgarian Personal Data Protection Act.

When you use the Website, create an account, or apply for membership, we may collect and process Personal Data including your name, email address, company name, professional role, and other information you voluntarily provide. This data is processed for the following purposes:

While BGDA endeavors to ensure the accuracy and completeness of the information presented, we make no guarantees regarding the reliability, timeliness, or completeness of the listings. Studios and professionals listed in the directory may request corrections or removal of their listing by contacting BGDA directly.

BGDA organizes and participates in various events, including meetups, game jams, conferences, and workshops. Event registration through the Website may be subject to additional terms and conditions specific to each event.

BGDA reserves the right to modify, postpone, or cancel events at its discretion. In such cases, BGDA will make reasonable efforts to notify registered participants in a timely manner. Unless otherwise stated, BGDA shall not be liable for any costs incurred by participants as a result of event changes or cancellations.

The Website and its Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts in the city of Burgas, Republic of Bulgaria.

For Members, any disputes related to membership rights and obligations shall be resolved in accordance with the dispute resolution mechanisms provided in the Statutes of BGDA.
